EXXN Engineering, hereinafter referred to as THE COMPANY responsible for the website, hereinafter referred to as RESPONSIBLE, makes this document available to users, with the intention of complying with the obligations set forth in Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSICE), as well as informing all users of the website about the conditions of use.

Any person who accesses this website assumes the role of a user, committing to the strict observance and compliance with the provisions set forth here, as well as any other legal provisions that may apply.

THE COMPANY reserves the right to modify any type of information that may appear on the website, without any obligation to notify or inform users of such changes, understanding that publication on THE COMPANY's website is sufficient.

Through the Website, we offer Users the opportunity to access information about our services.


3. Privacy and data processing


When access to certain content or services requires providing personal data, Users will guarantee its truthfulness, accuracy, authenticity, and validity. The company will give such data the appropriate automated processing based on its nature or purpose, as indicated in the Privacy Policy section.


4. Industrial and intellectual property


The User acknowledges and agrees that all content displayed on the Web Space, particularly designs, texts, images, logos, icons, buttons, software, trade names, trademarks, or any other signs susceptible to industrial and/or commercial use, are subject to Intellectual Property rights. All trademarks, trade names, or distinctive signs, as well as all industrial and intellectual property rights over the content and/or any other elements embedded on the page, are the exclusive property of the company and/or third parties, who have the exclusive right to use them in economic transactions. Therefore, the User agrees not to reproduce, copy, distribute, make available, or in any other way publicly communicate, transform, or modify such content, keeping the company harmless from any claims arising from the breach of such obligations.

Under no circumstances does access to the Web Space imply any type of waiver, transfer, license, or total or partial assignment of such rights, unless expressly stated otherwise. These General Conditions of Use of the Web Space do not grant Users any other rights to use, alter, exploit, reproduce, distribute, or publicly communicate the Web Space and/or its Contents other than those expressly provided herein. Any other use or exploitation of any rights will be subject to prior and express authorization specifically granted for that purpose by the company or the third party holding the affected rights.

The contents, texts, photographs, designs, logos, images, computer programs, source codes, and, in general, any intellectual creation existing in this Space, as well as the Space itself as a whole, as a multimedia artistic work, are protected as copyright by intellectual property legislation. The company holds the rights to the elements that make up the graphic design of the Web Space, including menus, navigation buttons, HTML code, texts, images, textures, graphics, and any other content of the Web Space or, in any case, has the corresponding authorization for the use of such elements. The content provided in the Web Space may not be reproduced in whole or in part, nor transmitted, nor registered by any information retrieval system, in any form or by any means, unless prior written authorization is obtained from the aforementioned Entity.

It is also prohibited to remove, evade, and/or manipulate the "copyright" as well as the technical protection devices, or any information mechanisms that may contain the contents. The User of this Web Space agrees to respect the stated rights and to avoid any actions that could harm them, reserving the company the right to exercise any means or legal actions that correspond to it in defense of its legitimate intellectual and industrial property rights.


5. Obligations and responsibilities of the user of the Web space


The User agrees to:

  1. Make appropriate and lawful use of the Web Space as well as the content and services, in accordance with: (i) the applicable legislation at all times; (ii) the General Terms of Use of the Web Space; (iii) the morals and good customs generally accepted; and (iv) public order.
  2. Provide all the means and technical requirements necessary to access the Web Space.
  3. Provide truthful information when filling out the personal data forms contained in the Web Space and keep them updated at all times so that they reflect, at all times, the User's actual situation. The User will be solely responsible for any false or inaccurate statements made and for any damages caused to the company or third parties by the information provided.

Notwithstanding what is established in the previous section, the User must also refrain from:

  1. To make unauthorized or fraudulent use of the Web Space and/or the contents for illegal purposes or effects, prohibited in these General Conditions of Use, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload, deteriorate, or prevent the normal use of the services or the documents, files, and all kinds of content stored on any computer equipment.
  2. Accessing or attempting to access restricted resources or areas of the Web Space without meeting the required conditions for such access.
  3. Cause damage to the physical or logical systems of the Web Space, its providers, or third parties.
  4. Introducing or spreading computer viruses or any other physical or logical systems that may cause damage to the physical or logical systems of the company, suppliers, or third parties.
  5. Attempt to access, use, and/or manipulate the company's data, third-party providers, and other Users.
  6. Reproduce or copy, distribute, allow public access through any mode of public communication, transform or modify the contents, unless authorized by the holder of the corresponding rights or unless it is legally permitted.
  7. Remove, hide, or manipulate the notes on intellectual or industrial property rights and other identifying data of the rights of the company or third parties incorporated into the content, as well as the technical protection devices or any information mechanisms that may be embedded in the content.
  8. Obtain and attempt to obtain the contents using means or procedures other than those that, as applicable, have been made available for this purpose or have been expressly indicated on the web pages where the contents are located or, in general, those that are commonly used on the Internet as they do not pose a risk of damage or impairment to the web space and/or the contents.
  9. In particular, and by way of mere indication and not exhaustive, the User agrees not to transmit, disseminate, or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software, and, in general, any kind of material that: • In any way is contrary to, belittles, or infringes upon the fundamental rights and public freedoms recognized constitutionally, in International Treaties, and in the rest of the current legislation. • Induces, incites, or promotes criminal, derogatory, defamatory, violent actions, or, in general, actions contrary to the law, morality, generally accepted good customs, or public order. • Induces, incites, or promotes actions, attitudes, or thoughts discriminatory based on sex, race, religion, beliefs, age, or condition. • Incorporates, makes available, or allows access to criminal, violent, offensive, harmful, degrading products, elements, messages, and/or services, or, in general, those contrary to the law, morality, and generally accepted good customs or public order. Induces or may induce an unacceptable state of anxiety or fear. • Induces or incites involvement in dangerous, risky, or harmful practices for health and mental balance. • Is protected by intellectual or industrial property legislation belonging to the company or third parties without the intended use being authorized. • Is contrary to the honor, personal and family privacy, or the personal image of individuals. • Constitutes any type of advertising. • Includes any type of virus or program that prevents the normal functioning of the Web Space.

If you are provided with a password to access some of the services and/or content of the Web Space, you are obliged to use it diligently, keeping it secret at all times. Consequently, you will be responsible for its proper custody and confidentiality, committing not to disclose it to third parties, either temporarily or permanently, nor to allow access to the aforementioned services and/or content by unauthorized persons. Likewise, you are obliged to notify the company of any fact that may imply improper use of your password, such as, by way of example, its theft, loss, or unauthorized access, in order to proceed with its immediate cancellation. Consequently, as long as you do not make the aforementioned notification, the company will be exempt from any responsibility that may arise from the improper use of your password, and you will be responsible for any unlawful use of the content and/or services of the Web Space by any illegitimate third party. If you negligently or willfully fail to comply with any of the obligations established in these General Conditions of Use, you will be liable for all damages that may arise from such non-compliance for the company.


6. Responsibilities


Access is not guaranteed to be continuous, nor is the proper viewing, downloading, or usefulness of the elements and information contained on the website guaranteed, which may be impeded, hindered, or interrupted by factors or circumstances beyond its control. It is not responsible for decisions that may be made as a consequence of accessing the content or information provided.

The service may be interrupted, or the relationship with the User may be terminated immediately, if it is detected that the use of their Web Space, or any of the services offered therein, is contrary to these General Terms of Use. We are not responsible for any damages, losses, claims, or expenses arising from the use of the Web Space.

It will only be responsible for removing, as soon as possible, the content that may cause such harm, provided that it is notified. In particular, we will not be responsible for any damages that may arise, among others, from:

  1. Interferences, interruptions, failures, omissions, telephone malfunctions, delays, blockages, or disconnections in the operation of the electronic system, caused by deficiencies, overloads, and errors in the telecommunications lines and networks, or by any other cause beyond the control of the company.
  2. Illegitimate intrusions through the use of malicious programs of any kind and by any means of communication, such as computer viruses or any others.
  3. Improper or inappropriate use of the Web Space.
  4. Security or navigation errors caused by a malfunction of the browser or by the use of outdated versions of it. The web space administrator reserves the right to remove, in whole or in part, any content or information present in the Web Space.

The company excludes any liability for damages of any kind that may arise from the improper use of the freely available services by the Users of the Web Space. It is also exempt from any responsibility for the content and information that may be received as a result of the data collection forms, which are solely for the provision of consultation and inquiry services. On the other hand, in the event of causing damages due to illegal or incorrect use of such services, the User may be held liable for the damages caused.

You will keep the company harmless against any damages and losses arising from claims, actions, or lawsuits by third parties as a result of your access to or use of the Web Space. Likewise, you agree to indemnify against any damages and losses that arise from your use of "robots," "spiders," "crawlers," or similar tools used for the purpose of collecting or extracting data or any other actions on your part that impose an unreasonable burden on the operation of the Web Space.


7. Hyperlinks


The User agrees not to reproduce in any way, not even through a hyperlink, the Web Space, as well as none of its contents, except with the express and written authorization of the file manager.

The Web Space may include links to other web spaces managed by third parties, in order to facilitate the User's access to information from collaborating and/or sponsoring companies. Accordingly, the company is not responsible for the content of such web spaces, nor does it position itself as a guarantor or as a offering party of the services and/or information that may be offered to third parties through third-party links.

The User is granted a limited, revocable, and non-exclusive right to create links to the homepage of the Website solely for private and non-commercial use. Websites that include a link to our Website (i) may not misrepresent their relationship or claim that such a link has been authorized, nor include trademarks, trade names, commercial names, logos, or other distinctive signs of our company; (ii) may not include content that could be considered tasteless, obscene, offensive, controversial, that incites violence or discrimination based on sex, race, or religion, contrary to public order or illegal; (iii) may not link to any page of the Website other than the homepage; (iv) must link to the actual address of the Website, without allowing the linking website to reproduce the Website as part of its own site or within one of its "frames" or create a "browser" over any of the pages of the Website. The company may request, at any time, that any link to the Website be removed, after which it must be removed immediately.

The company cannot control the information, content, products, or services provided by other websites that have established links to the website.


8. Data Protection


To use some of the Services, the User must first provide certain personal data. The company will automatically process this data and apply the corresponding security measures, all in compliance with the GDPR, LOPDGDD, and LSSI. The User can access the policy followed in the processing of personal data, as well as the establishment of the previously set purposes, under the conditions defined in the Privacy Policy.


9. Cookies


The company reserves the right to use "cookie" technology on the Web Space, in order to recognize you as a frequent User and personalize your use of the Web Space by pre-selecting your language or more desired or specific content.

The cookies collect the user's IP address, with Google being responsible for the processing of this information.

Cookies are files sent to a browser by a web server to record the user's browsing on the web space when the user allows their reception. 10. Representations and Warranties


In general, the content and services offered on the Web Space are for informational purposes only. Consequently, by offering them, no warranty or statement is provided regarding the content and services offered on the Web Space, including, by way of example, warranties of legality, reliability, usefulness, truthfulness, accuracy, or merchantability, except to the extent that such statements and warranties cannot be excluded by law.


11. Force Majeure


The company will not be liable in any case of inability to provide service if it is due to prolonged interruptions of the electricity supply, telecommunications lines, social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the Government, and in general all cases of force majeure or fortuitous events.


12. Dispute resolution. Applicable law and jurisdiction


The present General Conditions of Use, as well as the use of the Web Space, will be governed by Spanish legislation. For the resolution of any disputes, the parties will submit to the Courts and Tribunals of the registered office of the website's Responsible Party.

In the event that any provision of these General Terms of Use is found to be unenforceable or null under applicable law or as a result of a judicial or administrative ruling, such unenforceability or nullity shall not render these General Terms of Use unenforceable or null as a whole. In such cases, the company will proceed to modify or replace that provision with another that is valid and enforceable and that, to the extent possible, achieves the objective and intent reflected in the original provision.
